Losing a loved one is the most difficult experience, and figuring out how to distribute their assets can be daunting and time consuming. Administration/probate is the process by which estate assets are distributed to their designated beneficiaries. The key difference between probate and administration is whether your relative had a will. If they did, it is a probate proceeding, and the assets are distributed according to the will. If not, it is an administration proceeding, and the assets are distributed according to New York intestacy laws (intestacy means death without a will).
